Welcome to Fancanon. These Terms and Conditions (“Terms”) govern your access to and use of the Fancanon website located at fancanon.com, any subdomains, mobile applications, and all related services (collectively, the “Platform”), which are owned and operated by Fancanon LLC (“Fancanon,” “we,” “us,” or “our”).

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. BY CREATING AN ACCOUNT, ACCESSING, OR USING THE PLATFORM IN ANY WAY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS OR USE THE PLATFORM.

1. Eligibility and Account Registration

1.1 Age Requirement. You must be at least 13 years of age to use the Platform. If you are between the ages of 13 and 18, you represent that you have your parent or legal guardian’s permission to use the Platform and that they have agreed to these Terms on your behalf. We may request written confirmation of such consent at any time.

1.2 Account Creation. You must provide accurate, current, and complete information during the registration process and keep your account information updated. You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately at support@fancanon.com of any unauthorized use of your account or any other breach of security.

1.3 One Account Per Person. You may not create more than one personal account. You may not create an account for anyone else, or use another individual’s account, without their express permission.

2. User Content and Conduct

2.1 Definition of User Content. “User Content” means any story, chapter, comment, profile picture, message, and any other text, image, or material that you upload, post, transmit, or otherwise make available on the Platform.

2.2 Your Ownership and License to Fancanon. You retain all intellectual property rights in your original User Content. By posting User Content on the Platform, you grant Fancanon a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (strictly for the purpose of formatting, transposing, or displaying your content on the Platform), distribute, publicly perform, and display such User Content in connection with operating, providing, improving, and promoting the Platform. This license ends when you delete your User Content or your account, except (a) to the extent your content has been shared with other users and they have not deleted it, (b) where we are required to retain copies for legal or compliance reasons, or (c) as reasonably necessary for the continued functioning of our systems.

2.3 Responsibility for Your Content. You are entirely responsible for all User Content you post. You represent and warrant that you own or have obtained all necessary licenses, rights, consents, and permissions to publish your User Content, and that your User Content does not and will not infringe the copyright, trademark, trade secret, right of publicity, right of privacy, or any other intellectual property or proprietary right of any third party.

2.4 Prohibited Conduct. You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any federal, state, or local law or regulation.
  • Harass, intimidate, stalk, bully, defame, or threaten any other user.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Upload or transmit any viruses, worms, malicious code, or any other destructive technology.
  • Use any automated means (robots, spiders, scrapers) to access or collect data from the Platform without our prior written consent.
  • Post unsolicited advertising, spam, chain letters, or any other form of unauthorized solicitation.

3. Content Policies and Rules

Fancanon is a platform dedicated to fan fiction and creative expression. To keep the community safe and lawful, you must adhere to the Content Policy which you will find here - Content Policy.

4. Copyright Policy and DMCA Compliance

4.1 Respect for Intellectual Property. We respect the intellectual property of others and expect our users to do the same. This Platform is a space for transformative fan works, but it is not a sanctuary for wholesale reproduction of copyrighted material. If you believe that your copyrighted work has been posted on the Platform in a manner that constitutes copyright infringement, you may submit a notification pursuant to the Digital Millennium Copyright Act (17 U.S.C. § 512).

4.2 Filing a DMCA Takedown Notice. To be effective, your notification must be a written communication addressed to our designated Copyright Agent and must include substantially the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material on the Platform (e.g., a specific URL).
  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

4.3 Counter-Notification. If you believe that your User Content was removed or access disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, that you consent to jurisdiction of any judicial district in which Fancanon may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

If we receive a valid counter-notification, we will forward it to the original complaining party and may restore the removed content within 10 to 14 business days, unless the copyright owner files a court action seeking to restrain the activity.

4.4 Repeat Infringer Policy. In accordance with the DMCA and other applicable law, it is our policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We also reserve the right to terminate access based on a single, egregious infringement.

4.5 Transformative Works and Fair Use. We encourage copyright holders to consider the fair use doctrine before submitting a takedown notice against a fan work. A non-commercial, transformative fan fiction that does not substitute for the original work and uses only as much of the original as necessary may be protected as fair use. However, Fancanon is not a court and cannot adjudicate fair use disputes. We process DMCA notices as required by law. If you, as a user, receive a takedown notice and believe your work is fair use, you may wish to seek independent legal counsel.

5. Platform Features and Interactions

5.1 Publishing and Interacting. You may publish fan fiction stories, add chapters, comment on chapters and reply to comments, and use the “like”/”unlike” and “follow”/”unfollow” functions. You acknowledge that these interactions (including your profile, follows, and likes) are public and may be viewed by other users.

5.2 Comments and Replies. All comments and replies constitute User Content and must fully comply with these Terms, including the content policies in Section 3. We are not responsible for the substance of any comment, and we may remove comments at our discretion, without prior notice.

5.3 Reporting System. We offer mechanisms to report users, stories, chapters, and comments for violations of these Terms. Fancanon will review such reports in good faith, but makes no guarantee regarding the timing or outcome of any review. Knowingly submitting a false or misleading report is a violation of these Terms and may result in suspension or termination of your account.

6. Third-Party Links and Content

The Platform may contain links to third-party websites, advertisements, or resources. These links are provided for your convenience only. We do not endorse, and are not responsible for, the availability, accuracy, or content of any third-party site. You access such sites at your own risk, subject to their own terms of use and privacy policies.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, available at Privacy Policy . By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

8. Term and Termination

These Terms remain in full force and effect while you use the Platform. We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without prior notice. Upon termination, all licenses and rights granted to you under these Terms will immediately cease. We may delete or retain your User Content in accordance with our standard data retention practices and legal obligations. The provisions of these Terms that by their nature should survive termination (including, without limitation, Sections 2.3, 2.4, 9, 10, 11, 12, and 13) shall survive.

9. Disclaimer of Warranties

YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FANCANON, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM FANCANON OR THROUGH THE PLATFORM WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FANCANON, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL FANCANON’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE EXTENT NOT PROHIBITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless Fancanon, its parent company, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including without limitation any copyright, trademark, trade secret, right of publicity, or privacy right; and (d) any claim that your User Content caused damage to a third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

12. Governing Law and Dispute Resolution

12.1 Governing Law. These Terms and any dispute arising out of or in connection with your use of the Platform shall be governed by and construed in accordance with the laws of the United States and the State of NY , without giving effect to any principles of conflicts of law that would result in the application of the laws of another jurisdiction.

12.2 Jurisdiction and Venue. You and Fancanon agree to submit to the exclusive personal jurisdiction of the state and federal courts located in New York, USA for any legal action or proceeding arising out of these Terms or the Platform. You waive any objection to such venue based on inconvenience or any other ground.

12.3 Class Action Waiver. To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and Fancanon each waive the right to a trial by jury.

13. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by sending an email to the address associated with your account or by prominently posting a notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date of any modified Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue using the Platform.

14. General Provisions

14.1 Entire Agreement. These Terms, together with our Privacy Policy and any additional policies or guidelines posted on the Platform, constitute the entire agreement between you and Fancanon regarding your use of the Platform, superseding any prior agreements.

14.2 Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

14.3 No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment. You may not assign or transfer these Terms, or any rights or licenses granted hereunder, without our prior written consent. We may assign or transfer these Terms without restriction and without notice to you.

14.5 Notices. Any notices required or permitted to be given by us under these Terms may be provided via email to the address you provide, or by posting on the Platform. You agree that all notices provided electronically satisfy any legal requirement that such communications be in writing.
